Application for a Complying Development Certificate (CDC) - A Complying Development Certificate is an alternative to Development Approval (DA) and is only available for work determined as complying development under the council's planning controls or state planning policy. When a CDC is issued, there is no requirement for a Development Approval (DA) or Construction Certificate (CC).
Complying Development Certificate can only be approved if the proposed development complies with requisite planning controls and the Building Code of Australia (BCA) - now the National Construction Code (NCC). Accredited certifiers and councils can issue Complying Development Certificates. The certificate must be obtained before any building work commences, including site works such as demolition and excavation.
Application for Construction Certificate (CC) is made subsequent to Development Approval Consent. Once you receive the Development Approval Consent document after submitting a DA to the council, you will require a Construction Certificate before the commencement of building work. If you have a Complying Development Certificate, you will not require a Construction Certificate.
A Construction Certificate confirms that building plans comply with the BCA, are 'consistent', and comply with relevant conditions of the development consent. Accredited certifiers and councils can issue construction certificates. A Construction Certificate or Complying Development Certificate must be obtained before building work commences. Without one, you cannot obtain an Occupancy Certificate at the completion of your building work.
Application for Occupancy Certificate (when the property is completed) - Before you can occupy the building, you must apply for and obtain an Occupancy Certificate from your Principle Certifying Authority (PCA). The PCA will inspect the completed building work to determine if it is suitable for occupancy. If satisfied, they will issue an Occupancy Certificate.
In the ACT region, before you can erect a building or other structure, you must obtain Development Approval (DA). This can only be processed by Environment and Planning (formerly known as ACT Planning and Land Authority). However, as an Accredited Certifier, we can assist you in determining whether your project is exempt from requiring a DA.
If a DA is required, we can manage and advise to ensure your application does comply, thereby avoiding delays or requisitions to resubmit the application with Environment and Planning. Once the DA has been obtained or we have established that your project is exempt from it, then the Appointment of a Certifier/Application for Building Approval process begins.
